Subscription Terms & Cancellation Policy

By purchasing a subscription from Picky Packs, you acknowledge that you have read, understood, and agree to be bound by these terms:

1. Automatic Renewal & Billing Your subscription will automatically renew weekly at the current subscription price ($175 for The Picky Club, $250 for The Founders Club). By subscribing, you authorize us to charge your payment method on a recurring basis. You will receive email confirmation before each billing cycle.

2. Cancellation Rights You may cancel your subscription at any time by:

  • Logging into your customer account and managing your subscription
  • Contacting us at hello@pickypacks.com

Cancellations must be submitted at least 7 days (one week) before your next scheduled delivery date to avoid being charged for the upcoming shipment. Cancellations received with less than 7 days' notice will take effect for the following billing cycle.

3. Pausing Your Subscription You may pause your subscription at any time through your customer account or by contacting us. Paused subscriptions will automatically resume after 2 weeks unless you contact us to extend the pause or cancel your subscription. The same 7-day advance notice requirement applies.

4. Product Selection & Substitutions We curate a selection of products for each subscription box. Product selection may vary and is subject to change based on availability. We reserve the right to substitute products of equal or greater value without prior notice. Products are sourced from third-party vendors and manufacturers.

5. Allergens & Dietary Restrictions IMPORTANT: Our products may contain or come into contact with common allergens including but not limited to: milk, eggs, tree nuts, peanuts, wheat, soy, fish, shellfish, and sesame. Product selection varies weekly.

It is solely your responsibility to:

  • Review all product ingredients and allergen information before consumption
  • Contact us before subscribing if you have food allergies or dietary restrictions
  • Determine suitability of products for your individual needs

We cannot and do not guarantee that products will be free from allergens, suitable for specific dietary needs, or safe for individuals with food allergies or sensitivities. By subscribing, you acknowledge and accept all risks associated with food allergies and dietary restrictions.

6. Perishable Products & Food Safety Our subscription boxes contain perishable food items that require proper handling and storage.

You acknowledge and agree that:

  • Products must be refrigerated or stored according to package instructions immediately upon receipt
  • You are responsible for proper food handling and storage after delivery
  • Products should be consumed by the date indicated on packaging
  • We are not liable for spoilage, contamination, or foodborne illness resulting from improper storage, handling, or delayed retrieval of delivered packages
  • You must inspect products upon receipt and report any quality issues within 48 hours of delivery

7. Delivery Local delivery to the address you provide.

You acknowledge that:

  • We are not responsible for stolen, lost, or damaged packages after carrier confirms delivery
  • We are not liable for delays caused by weather, carrier issues, or events beyond our control
  • You must provide a safe delivery location and retrieve packages promptly
  • Delivery to incorrect addresses due to customer error is not eligible for refund or replacement

8. Refunds & Returns Once an order has been processed and shipped, it cannot be cancelled. Due to the perishable nature of food products:

  • We cannot accept returns on opened, consumed, or improperly stored items
  • Refunds or replacements are issued at our sole discretion
  • Quality issues must be reported within 48 hours of delivery with photographic evidence

9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claims arising from your subscription shall not exceed the amount you paid for the subscription in the 3 months prior to the claim
  • We are not liable for any indirect, incidental, consequential, special, or punitive damages
  • We are not liable for personal injury, illness, allergic reactions, or any health-related issues arising from consumption of products
  • We are not liable for third-party product defects or issues with products manufactured by other companies

10. Indemnification You agree to indemnify, defend, and hold harmless Picky Packs, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our products
  • Your violation of these terms
  • Your violation of any rights of another party
  • Any allergic reactions or health issues related to product consumption

11. Modifications to Terms We reserve the right to modify subscription pricing, product selection, or these terms at any time with at least 30 days' notice via email. Continued use of the subscription after notice constitutes acceptance of the new terms.

12. Dispute Resolution Any disputes arising from this subscription shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits. This agreement is governed by the laws of California, United States, and any arbitration or legal proceedings shall take place in Orange County, California.

13. Force Majeure We are not liable for failure to perform our obligations due to events beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, labor disputes, supplier failures, or transportation disruptions.

14. Account Security You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

15. Severability If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
